Gorakhpur tragedy: Allahabad HC grants bail to Dr Kafeel Khan

 Dr Kafeel Khan, an accused in the BRD Medical College case involving death of 63 children last August due to disruption in Oxygen supply has been finally granted bail. He got bail from the Allahabad high court after being in jail for the last eight months. 

"We had full faith in the judiciary that it will do justice to my brother who was made a scapegoat in the unfortunate deaths of infants at BRD Medical College in august last year," reacted Kashif Jameel, Dr Khan's brother.Shabishta Khan, Dr Kafeel's wife said, " My family suffered a lot during all these eight months. My husband is innocent. He paid the price for being a good human and a doctor who saved lives of many children. I thank judiciary, media, friends and relatives who stood by us during the time of crisis".  Justice Yashwant Verma of the single bench in Allahabad High Court granted approved his counsel’s application and granted bail to Dr Khan. The state standing counsels had opposed his bail application.

Earlier, Manish Bhandari, the owner of the Pushpa Sales Private Limited was granted bail by the Supreme Court after it was earlier rejected by the High Court. Other seven accused, including then Principal Rajeev Mishra, remained in jail.

Dr Kafeel in an open letter last week has alleged that he has been made a scapegoat in this entire incident. He had written sequence of events on that fateful day when oxygen supply was snapped by the supplier over non-payment and to plead his innocence. Significantly, in the letter he pointed that he became victim of Chief Minister Yogi Adityanath’s anger due to the media lauding his role in saving infants by arranging oxygen cylinders. “My life turned upside down when CM Yogiji Maharaj arrived on August 13 2017. He asked me : ‘So you are Dr Kafeel? You arranged cylinders?” I was like – ‘yes Sir”. He got angry –“so you think by arranging cylinders, you became hero, I will see to it,” he had stated in the letter circulated to the media.

His wife has alleged that he was denied medical care inside the jail. After which Kafeel Khan was given medical treatment by the jail authorities. 

Dr Kafeel is among the nine accused of the BRD Medical College and Hospital case involving death of 63 children, including infants, in August 2017 within four days due to disruption in supply of oxygen to medical wards due to non-payment of dues to the vendor. The state-run medical college is the single largest government-aided facility in Gorakhpur which also attends to the patients from nearby areas like Maharajganj, Deoria, Kushinagar, Basti, Siddharthnagar, Sant Kabirnagar, Ballia, certain areas of Bihar like Gopalganj and Siwan, besides border areas in neighboring Nepal..

In her press conference, Dr Shabistan had apprehended that the doctors lodged in the prison might be "killed." She said her husband suffered a heart stroke on March 29 but was not given proper treatment.
"Former BRD Medical College principal, Dr Rajiv Mishra, is suffering from liver disease and diabetes but he is also not getting proper medical attention," she had claimed. She had also said another accused, Dr Purnima Shukla, who is suffering from a hairline fracture, was also not getting the requisite medical attention.
