The mystery over who killed Haren Pandya has deepened after the Gujarat high court's acquittal of all the 12 people convicted in the case by the trial court. But the CBI, which had investigated the case, had investigated the allegation that the slain BJP leader was killed due to political rivalry but had not found anything incriminating. This is indicated by the testimony before the trial court by CBI's investigating officer Sushil Gupta. Gupta's testimony concluded on Nov 15, 2006.

Sushil Gupta's testimony reveals that the CBI had also interrogated Amit Shah, who is now an accused in the Sohrabuddin Sheikh fake encounter case. The agency had also questioned the city-based builder, Jaxay Shah, but it had found nothing incriminating. During his testimony before the trial court, Sushil Gupta said in reply to a question asked by the defence lawyer, BM Gupta, that he had come across no evidence against Modi that would allow him to interrogate the CM. "I did not investigate deeply into the political rivalry and competition between Pandya and Narendra Modi," the investigating officer had said.
When the lawyer said Vitthal Pandya had submitted 30 applications to the CBI, Sushil Gupta replied: “We received a number of applications but they were so non-specific, vague, and clueless that I did not find it necessary to record their statements.”

Sushil Gupta further said the agency had tried to find out about Pandya's political, personal and business connections. The CBI had interrogated several people but had recorded the statement of only Jagruti Pandya because it did not get any clues from their questioning. The investigating officer, had informed the court that between March 2003 and May 2003, the agency had interrogated several people.
