Woman murder accused wants narco tests to prove innocence

In an unusual step, a woman facing murder charges has moved a Delhi court pleading to subject her to lie-detection and narco-analysis tests to prove her "innocence".

Accused Rincymol Thomas, in her petition, claimed that she was in fact the victim and that she was raped and implicated in the case.

"Through narco analysis/lie detector test she can afford evidence which will disprove the allegation levelled against her. The authenticity and correctness of the heinous offence of rape done by an accused can also be proved by conducting the tests," the application said.

Thomas, 25, has been lodged at Tihar jail since December 9 last year after she was arrested for allegedly killing two-year-old Shamsher by throwing the baby from the first floor of her house.

In the application filed through counsel Kunwarjeet Singh, she claimed that she was implicated in the case by her brother-in-law Mohd Kalam, father of the deceased, who, she alleged, raped her on December eight.

When she raised a hue and cry, Kalam, who came to her house with his son, threw the child from the first floor as he wanted to create his defence by implicating her in the case, she alleged in the petition.

The woman, in jail with her 15-month-old baby, claimed that her husband Lal Mohammed and his brother Mohd Kalam were having property-related disputes. She also alleged that her in-laws were not happy with her marriage with Lal as it was an inter-religious one.

After the police refused to lend credence to her allegations of rape, she filed an application in the court which had on February two directed SHO of Aman Vihar police station to register an FIR and probe the matter. The police had sent her medical report for forensic examination.

Her application seeking the lie-detection and narco-analysis tests are likely to come up for hearing before the court of additional sessions judge Sanjeev Aggarwal on April 8.

"The applicant/petitioner is languishing in jail for the last three-and-half months with her infant child. Neither applicant nor her son has committed anything wrong but unnecessarily, they were facing most severe condition of the jail," her application stated.

The woman, who worked as a nurse in a hospital here, also demanded a compensation of Rs5 lakh for rehabilitation of
herself and her child.
