With the new notification, buildings and slums falling within the 500-metre zone can now be rebuilt, though government agencies will have to hold at least 51% stake in slum redevelopment projects.
In a major relief for owners of property within 500 metres of the Mumbai coastline, the central government has removed the 20-year-old restrictions on construction in the ‘coastal regulation zone’ (CRZ).
With the new notification, buildings and slums falling within the 500-metre zone can now be rebuilt, though government agencies will have to hold at least 51% stake in slum redevelopment projects.
“The restrictive nature of the 1991 notification caused hardships.. slum dwellers and others living in dilapidated and unsafe buildings in Mumbai,” Jairam Ramesh, minister for environment and forests (MoEF) said in his pamphlet explaining the changes.
Many buildings in Mumbai have been caught in a time-warp for 20 years as repairing, reconstructing or renovating them would have attracted the provisions of the 1991 CRZ notification.
It will also help slum-dwellers living close to the sea who have so far been unable to organize themselves into housing societies, assign their land to a developer and move into their own multi-storeyed apartments after 2-3 years.
The floor space index (FSI) - which determines how many floors can be built up - has been left to the local Town and Country Planning Regulations. No new buildings can be built closer to the sea than an existing road or building.
To ensure transparency, the new notification requires both slum redevelopment projects as well as other redevelopment projects within the 500-metre zone to display “on large notice boards” such details as the number of flats being made, along with the names of the slum-dwellers for whom they are being made.
The notice board will also show the number of extra flats that will be available for free sale by the builder to recover his construction costs. In cases of slums, the entire project will be covered by the Right to Information (RTI) Act.
The new notification also gives special status to areas with Greater Mumbai recognized by the government of Maharashtra as ‘Koliwadas’ and all open spaces in Mumbai such as parks, playgrounds, gardens etc...
Such areas will not be considered as part of ‘urban coastal’ regions like the rest of Mumbai, but as ‘rural coastal’ regions. The new status will make it difficult to construct anything within 100 metres of the high-tide line in such areas, while only traditional fishing dwellings may be permitted between 100 metres to 200 metres. In the remaining part of the 500-metre zone, tourism related structures such as hotels will be permitted, in addition to “traditional and customary” uses such as fishing villages.
