Nidhi Gupta suicide: No high court relief for in-laws

The husband and parents-in-law of Nidhi Gupta, who flung her two children and then jumped from her building in March, failed to get any relief from the Bombay high court.

A division bench of Justice AM Khanwilkar and Justice PD Kode on Friday dismissed the petition filed by Nidhi’s husband, Rakesh, and in-laws, Murarilal and Sangeeta, seeking quashing of the FIR filed against them.

They were booked by the Dindoshi police for harassment and abetment to suicide.

On March 8, Nidhi flung her children from the 19th floor of her Malad building and then jumped to her death. Nidhi married Rakesh in 2002 and used to stay with her in-laws.

Nidhi’s father, Bimal, lodged a complaint with the police following which the three were arrested and later released on bail.
Ashok Aaraogi, advocate for the Guptas, argued that neither Nidhi’s suicide note nor Bimal’s complaint mention about harassment by the Guptas.

“There is no material against them,” argued Saraogi.
Additional public prosecutor Konde Deshmukh told the court that the police are awaiting a report from the hand writing experts who analysed Nidhi’s suicide note. The police will file a charge sheet after getting the report.

While dismissing the petition, the court observed: “Investigation is still on. At this stage a quashing petition cannot be entertained. Once the charge sheet is filed, the accused can seek remedy before the appropriate court.”

The court has directed the police to expedite the probe and file a charge sheet at the earliest.
