After a legal battle of seven years, the four daughters and widow of an accident victim recently were awarded an insurance claim of Rs4,30,000.
The motor accident claims tribunal presided over by principal and district judge Anant Badar on January 23 ordered respondent Tanaji Dnyandeo Sutar, who is owner of a vehicle, to pay Rs4,30,000 to the petitioners towards full and final
compensation including Rs50,000.
The deceased, Rajaram Vasant Navale, 40, died in an accident on Lonand-Satara state highway at Tadawale Wagholi in Satara district on September 6, 2004.
When the accident took place, Rajaram was the sole bread earner of the family and all his daughters were under aged and were studying in schools.
Rajaram’s widow Asha, 43, and his four daughters — Priyanka Rajaram Navale, 22, Kamal Rajaram Navale, 17, Madhuri Rajaram Navale, 16, and Sujata Rajaram Navale, 10, of Khandala in Shirur filed the petition before the motor accident claims tribunal on December 22, 2004.
In the petition filed by Asha, Gulab Nanabhau Jagtap (driver) of Talegaon Dhamdhere in Shirur, Sunil Nanabhau Marathe of Pradhikaran, Tanaji Dnyandeo Sutar of Shirur and Sayaji Dashrath Navale of Karegaon in Shirur were made respondents.
Asha filed a claim for Rs4,00,000 under section 166 of the Motor Vehicles Act, 1988 through her lawyer SP Deo and prayed for awarding a compensation of Rs4 lakh from respondents on account of Rajaram’s death in the accident.
Forty-year-old Rajaram at the time of accident was a truck driver and was earning Rs3,500 per month. On the day of the accident, Rajaram went along with Gulab Jagtap, as a cleaner in the Tempo.
Tanaji Sutar in the claim petition is said to be the owner of the Tata Tempo. According to claimants, Gulab Jagtap was driving the Tata Tempo in a rash and negligent manner by violating traffic rules.
Because of rash and negligent driving, that Tempo fell into a ditch on the left side of the road at Tadvale Wagholi and Rajaram died in the accident.
The court Sutar to pay Rs4,30,000 to the petitioners as full and final compensation including Rs50,000 with interest at the rate of 6% per annum from the date of filing the petition.
