NEW DELHI: Power Grid Corporation is now free to award contracts for transmission line tower packages to any bidder other than the Kolkata-based Electrical Manufacturing Company (EMC).
This removes the lingering uncertainty over multicrore contracts across the country.
The Supreme Court on Friday refused to stay a Delhi High Court judgment that upheld the Power Grid's decision to bar EMC from the bid.
A bench headed by justice C K Thakker issued notices to the Centre and PowerGrid on EMC's appeal over ban.
The judges had clarified that PowerGrid's action regarding accepting the bids from other contenders would be subject to the final outcome of the petition.
PowerGrid had invited tenders for transmission line tower packages for 765 KV S/C Gaya-Sasaram (148 kms), 765 KV S/C Gaya-Balia (235 kms) and 400 KV D/C (Quad) Maithon-Gaya transmission lines.
In its appeal EMC said the Power Grid's board of directors in a meeting on May 6 last decided against awarding the contract to EMC on the ground that it was not qualified for the bid as per the requirement.
EMC said the public sector company had arbitrarily deprived it of its right to execute the contract even though it was the lowest bidder.
EMC also contended that the term "satisfactorily completion" had not at all been defined in the bid documents.
The exchequer has suffered a loss of Rs 16.34 crore by not accepting its lowest bid, EMC said.
