Enforcement Directorate issues Blue Alert notice against Lalit Modi

The Blue Notice alert, which will be executed by the Interpol, has been issued to gather further information about Modi's whereabouts and his activities when he is abroad.

Investigating agencies have tightened the noose around Lalit Modi with the Enforcement Directorate (ED) issuing a ‘Blue Alert’ notice against the former IPL chief on Thursday. The alert is effective from October 1.

The notice was issued after efforts of the ED and other agencies failed to ensure his presence for questioning for the last two months. The ED is of the view that Modi is in possession of huge foreign exchange without permission. DNA was first to report that ED had issued notice to Lalit Modi.

Sources in the ED told this paper that the ‘Blue Alert’ is notified within the territorial jurisdiction of the country covering all airports and ports of entry and exit. This is not applicable at international airports/ports because such duties fall within the purview of the Interpol, which issues ‘Red Corner’ notices. The ED does not have the authority to issue an international lookout notice.

The alert means Modi can be intercepted and checked thoroughly before any foreign travel and can be detained in any port of embarkation and disembarkation. He will also have to make himself available for questioning by the ED.

But it does not mean that he will be detained. But he will have make himself available for personal questioning or grilling by the ED and the airport authorities are required to inform the ED before allowing him to leave the airport.

Mehmood Abdi, Modi’s counsel, said that Modi has been cooperating. “All summons and notices have been duly and timely replied. All documents asked for have been provided. As far as his personal appearance is concerned, he has given valid reasons for not being present in India due to grave security concerns,” Abdi said.

According to his lawyer, Modi offered to be available for questioning by the enforcement agencies through video-conferencing, or alternatively by being present before the overseas enforcement authorities at the Indian High Commission in London,” he added.
