Registration of notarised power of attorney must in Gujarat now, bill passed in house

Gujarat assembly also gave nod to pass the amendment bill of Stamp Act in consonance

The Gujarat assembly on Tuesday pass the bill making registration of notarised power of attorney documents mandatory in state. The government brought the Gujarat Registration(amendment) Bill, that was passed by the house with majority of the votes. Once this amendment comes under the implementation after approval of governor, it will be must for all the notorised power of attorney document been registered in the case of transfer of powers on immovable assets.

The revenue minister Kaushik Patel while bringing the bill in the house said, "This bill will prevent the cases of forgery of power of attorney documents and the person who purchases the property will be enabled to get the titles clear on the assets and to know on the proprietorship of the assets. With this amendment, the power of attorney made for the management or any other arrangements will have to be registered in the registrar office before the competent authority."

"The government has prepared special software named as "Garvi" for the digitisation of documents related to assets. The software can preserve the data like documents, photographs of concerned parties or persons, thumb impressions and video recording done during signing of documents," the minister added.

Patel also brought another bill for amendment in Gujarat Stamp Act to make changes in present act in consonance with amendment in Companies Act introduced by central government in 2013. The amendment was made because some references of various sections of the earstwhile Companies Act, 1956 still exist in the Gujarat Stamp Act, 1958 which were required to be changed with the corresponding sections of the Companies Act, 2013.

As per the amendment in Companies Act, the National Law Tribunal has been empowered to sanction the scheme for reconstruction of the company or companies involving merger or amalgamation of any two or more companies. The amendment also suggested to incorporate banking companies under the Stamp Act. This bill was passed unanimously by the house.

The Gujarat government also passed the Private University amendment Bill to give private university status to Atmiya University run by Sarvodaya Kelavni Samaj in Rajkot. The bill was passed by majority of votes and criticism of opposition who voted against.

WHAT ACT SAYS

As per the amendment in Companies Act, the National Law Tribunal has been empowered to sanction the scheme for the reconstruction of the company or companies involving merger or amalgamation of any two or more companies.
