CBI gave him clean chit in anti-riots case but court asks the agency to reopen it.
In a major setback for senior Congress leader Jagdish Tytler, a Delhi court on Wednesday set aside the CBI closure report and ordered the reopening of the case against him in connection with the 1984 anti-Sikh riots, following Indira Gandhi’s assassination.
The court said it was an obligation of the CBI to record statements of witnesses. Additional sessions judge Anuradha Shukla Bajaj gave the order on a plea filed by a riot victim, who is seeking a CBI inquiry into the killing of three people near Pulbangash gurdwara.
The court asked the CBI to record statements of three crucial witnesses whose testimonies seek to prove Tytler wrong by putting him at the centre of the area where the riots took place.
The CBI had given a clean chit to Tytler on April 2, 2009, claiming lack of evidence against him in the case pertaining to the murder of the three people on November 1, 1984.
Also, the Supreme Court upheld the life sentence awarded to four people for burning two men to death during the riots.
The Congress, however, seemed undisturbed by the court order against Tytler who is the party’s general secretary, in-charge of Odisha.
Party spokesperson Renuka Chaudhary said there was no proof against Tytler till now. “This is not new case. It’s been going on for a long time. Let the law take its course.”
She rejected the idea of comparing the case and accusations against Tytler with that of Gujarat chief minister Narendra Modi. Congress has been baying for Modi’s blood for the 2002 anti-Muslim riots in his state in the aftermath of the Godhra carnage. “If there is any proof against Jagdish Tytler, we will take steps against him,” Chaudhury said.
Tytler too appeared unfazed. “I have nothing to reveal or hide,” he said. He reminded that the CBI has investigated the case twice. The agency had filed a closure report favouring Tytler in 2007.
When the court rejected it, the CBI re-investigated and in 2009 announced that it had found no evidence against the Congress leader.
