Rajesh and Nupur Talwar have been acquitted of murdering their daughter Aarushi and domestic servant Hemraj in May 2008 case. The Allahabad High Court (HC) on Thursday acquitted Aarushi's parents and set aside November 25, 2013 ruling by special CBI court that found the couple guilty of murdering their daughter and their domestic help. While reacting after the judgment, Nupur Talwar reportedly said: We have got justice. Nupur Talwar, who is lodged in Ghaziabad's Dasna jail along with her husband Rajesh, was watching the proceedings on TV.
While allowing the appeal by Talwars, the High Court was of the view that as per the circumstances and evidence on record, the couple can't be held guilty. The court ruled that there is no clinching evidence that the Talwar's are guilty.
A division bench of the court comprising justices B K Narayana and A K Mishra upheld the appeals by the Talwars against the Ghaziabad CBI court order sentencing them to life imprisonment.
The court questioned the poor investigation and Talwars were given the benefit of doubt.
Aarushi was found dead in her bedroom at the Talwars' home in Noida near Delhi in May 2008. The family's Nepalese domestic help Hemraj was found killed on the terrace. The dentist couple was sentenced to life prison in 2013. They had appealed against their conviction.
"Deeply relieved. Had suffered for 10 year. Grateful to HC for acquitting them," said Vandana Talwar, Rajesh Talwar's sister-in-law.
"Grateful to judiciary. Have seen them suffering. It has been really testing. I am emotionally drained," said BG Chitnis, Nupur Talwar's father.
"Both Rajesh & Nupur Talwar have been acquitted and we are expecting that they will be out of jail tomorrow", said Lawyer of Rajesh & Nupur Talwar.
