Fake encounter: Supreme Court dismisses appeal of ex-Kerala DGP Vijayan

The Supreme Court today dismissed the appeal filed by former Kerala DGP P Vijayan, challenging his prosecution by the CBI in the alleged fake encounter killing of Naxalite leader Varghese in 1970.

A bench headed by justice P Sathasivam, however, allowed 85-year-old Vijayan to move the special CBI judge court in Kerala for exemption from personal appearance during the trial.

Vijayant had approached the apex court, challenging the framing of charges by the special CBI court on his alleged involvement in the killing of the naxalite leader.

The CBI had earlier chargesheeted the former DGP on the basis of the confessional statement made by police constable Ramachandran Nair, who confessed that he carried out the killing at the behest of his superior officers which included Vijayan, who was then a DIG.

The killing of the naxalite by police had sparked a nationwide furore.
