MACT awards Rs70K in compensation to man in accident case

The resident of Delhi said that the injuries suffered in 1999 rendered him permanently disabled.

A man who was rendered permanently disabled in a road mishap was awarded a compensation of Rs70,000 by the Motor Accident Claim Tribunal (MACT) but it rejected his demand for a higher amount on the possibility that he might have received the medical reimbursement.

"The petitioner has not produced original medical bills on the record, and has also failed to explain as to why the original documents are being withheld.

"It may also be possible that he must have taken reimbursement by producing original bills in his department or from any medical policy," Judge Anju Bajaj Chandna said.

The MACT passed the order on the plea of 57-year-old Gyan Chand seeking Rs15lakh in compensation from RV Dhhengra for causing him grievous injury by rash and negligent driving of a vehicle.

Chand, a resident of Delhi, said that the injuries suffered in 1999 rendered him permanently disabled.

Dhhengra, however, contended that he was not responsible for the accident, and has no liability to pay any compensation to the petitioner.

"I find that the evidence of the petitioner is consistent and convincing with respect to the accident," the court said while rejecting the contention.
