The municipal corporation of Delhi (MCD) today said it will challenge the Delhi high court order quashing its decision to increase the fee for installation of mobile towers in the city from Rs1 lakh to Rs5 lakh.
"We are taking legal opinion in the matter and we might move either a larger bench of the High Court or the Supreme Court," leader of MCD House Subhash Arya said.
In a relief to cellular companies, the Delhi high court had yesterday struck down MCD's decision to increase fee for installation of mobile towers saying it is beyond its jurisdiction.
Justice Rajiv Sahai Endlaw, however, said the cellular operators cannot install the towers without MCD's permission.
The court passed the order on a batch of petitions filed by different cellular operators, including the Cellular Operators Association, challenging MCD's decision to raise the fee five times and putting stringent conditions for installing towers in residential areas.
MCD had on April 8 last year hiked the licence fee from the earlier one-time payment of Rs1 lakh to Rs5 lakh for every five years.
As MCD began a sealing drive against mobile towers which were not in compliance with its new rule, the operators had approached the High Court which had on May 13 restrained the civic body from sealing the structures.
