The Bombay High Court on Monday adjourned the petition filed by choreographer Geeta Kapoor (42), seeking quashing of the case filed against her for rash and negligent driving, after the victim said he was not satisfied with the compensation amount.
A division bench of justices RV More and Anuja Prabhudessai was hearing Kapoor's petition which sought quashing of the complaint against her on the ground that she has reached a financial settlement with the victim.
Advocate Sachin Shetye, appearing for Kapoor, informed the HC that the choreographer and the victim, Nisar Noormohammed (37), and his family have arrived at a settlement amount.
He said, "We are seeking quashing by consent. Soon after the accident, Kapoor took the victim to Kokilaben Hospital and made sure that he was treated. The victim has suffered one fracture on his right knee. Kapoor has borne his medical expenses, which have summed up to Rs7 lakh. She has also given the victim a cheque for Rs3 lakh."
Advocate Niranjan Mogre, appearing for the victim's family, informed the court that the cheque has been received.
The high court, however, was not satisfied and queried if the Rs3 lakh amount was sufficient. The court then asked the victim, who was present in court in a wheelchair, if he and his family are happy with the settlement amount.
Noormohammed told the court that the amount will not suffice as he is out of work since the accident in March. "I am an electrician. Since the accident I am sitting at home. I have two children to look after. The lady (Kapoor) has paid for my medical expenses but I am not satisfied," he said.
The court then adjourned Kapoor's petition for two weeks, during which time the parties involved shall have another meeting and decide on the settlement terms.
On March 12, Kapoor was arrested after her Sedan knocked down Noormohammed, who was crossing the road in Versova. Kapoor did not flee from the spot and took the victim to hospital. She was later called to the police station and arrested for rash and negligent driving and causing hurt to another person. She was released on bail.
