Part of my earlier deposition wrong: 2G case witness to court

A Registrar of Companies (RoC) official today told a Delhi court, hearing the 2G spectrum case, that certain facts deposed by him earlier in the court during recording of his statement were "incorrect."

Deposing as a prosecution witness, RoC's Deputy Registrar Prem Lal Malik told Special CBI Judge OP Saini that earlier he had incorrectly said that the seizure memos of documents were prepared in CBI office as they were prepared in the RoC office.

"The seizure memos were typed in the office of the RoC. Earlier I had stated in my examination-in-chief that the seizure memos were prepared in the CBI office. However, their preparation was, in fact, done in the RoC office and my earlier statement in this regard may be incorrect," he said.

During his cross-examination, Malik failed to recollect if the agency had sent a letter requisitioning the documents from the RoC. During his deposition in the court earlier, he, however, had said the CBI had sent a letter requesting for the documents.

"Earlier, I had stated in my examination-in-chief that a letter was received from the CBI requisitioning the documents, but today I stated that I do not remember and this is due to the fact that many things are not retained in memory," he said.

Malik, whose recording of statement concluded today, said his earlier statement was a "mistake" and today he corrected it saying, "the documents were not produced by me before the Investigating Officer (of CBI) and they were either sent by dak or were taken by the IO himself from the RoC office."

He said he had not handed over any document personally in the RoC office or in the CBI office, adding that he had deposed about the details of the documents in the court only by reading the seizure memos.
