The Rajasthan High Court, on Thursday, lifted the stay given  to Lalit Modi on an order of the BCCI, under which it had banned Modi from taking part in any activity of any body affiliated with the cricket board. The order also kept Modi from participating in RCA activities as well.

The order was passed by single bench of Justice Manish Bhandari while hearing applications filed by BCCI and RCA.

The court stated that since the interest of either associations was not being affected by the stay, there was no reason to continue with it.

Asking the court to lift the stay, BCCI, in its application, stated that it had taken action against Modi, but the latter, instead of filing a petition in his name, had filed one through the Nagaur Cricket Association when the latter had no right to do so.  The RCA, too, has not acted against the Nagaur Cricket Association.

Advocate Mahesh Sharma, appearing for RCA, informed the court that BCCI had ordered RCA through a letter to act against Lalit Modi. And, in case they don’t act against him, the BCCI may take action against RCA. “But the RCA is not being able to penalise Modi because of court stay. If the stay is lifted then RCA can act against Modi,” RCA presented.

Making a joint hearing on both these applications, court lifted the stay, which was in Modi’s favour.

Notably, on October 17, single bench of the High Court had stopped action against Modi based on letter sent by BCCI to RCA. In the letter sent on October 3, it was said that Modi was stopped from the activities in the bodies affiliated with BCCI.

Meanwhile, speaking to dna, constituted attorney of Modi , Mehmood Abdi said that Modi is not a party to this litigation as it was district cricket association of Nagaur which filed the petition, he claimed the decision won’t have any bearing on the Modi’s eligibility for fighting RCA elections.
