With both Bihar Chief Minister Nitish Kumar as his predecessor and Janata Dal (United) chief and party's Rajya Sabha MP Sharad Yadav setting the stage for bitter parting of ways, Yadav is all set to move the Election Commission (EC) on Friday to seek control of the party.

Party sources close to Yadav, who has voiced his opposition to Kumar's decision to break the Bihar Mahagathbandhan, comprising JD(U), Lalu Yadav-led Rashtryiya Janata Dal and the Congress, and join hands with the BJP to form the government in Bihar, will file a petition before the EC under the Election Symbols (Reservation and Allotment) Order, 1968, seeking the party symbol arrow to be given to him.

In his petition, he is likely to claim that by joining hands with the BJP, Nitish had abandoned and tarnished the founding principles of the JD(U). Yadav, sources close him say, is also likely to contend that the faction led by Nitish has "voluntarily" relinquished membership of the party.

He is planning to tell the EC that he enjoys majority support among the rank and file of the party and hence should be allotted the party symbol.

He is also likely to ask the EC to grant him an opportunity to prove that he enjoys overwhelming support among the party rank and file and thus should be declared the JD(U).

Sources said Yadav, who is planning to share the stage with Lalu Yadav at the RJD rally in Patna on Sunday, could be shown the door by the Nitish faction.

It is learnt that if Yadav participates in the Sunday rally, the Nitish faction will request Rajya Sabha Chairman M Venkaiah Naidu to cancel his membership of the house for leaving the party.
