BMC justifies Juhu multi-parking

The BMC has defended before the Bombay high court its decision to allow multiple car parking in a new high-rise building at Juhu Vile Parle Development scheme saying it was done keeping in mind that it is a low-lying area.

Brihanmumbai Municipal Corporation (BMC) has defended before the Bombay high court its decision to allow multiple car parking in a new high-rise building at Juhu Vile Parle Development (JVPD) scheme saying it was done keeping in mind that it is a low-lying area.

The affidavit was filed in reply to a petition filed by Gulmohar Area Society’s Welfare Group challenging the permission granted by top civic officials for construction of a ground plus nine storeys building at JVPD. They alleged that the building has been constructed in gross violation of development Control Rules. The division bench, while adjourning the matter to four weeks ,said if steps are taken by any of the respondents, it will be subject to the further orders of the court.

In his December 2010 affidavit, assistant engineer (building proposal) Jayesh Engineer said that JVPD is a low-lying area and there is water-logging during monsoon. There are also constraints of height restrictions imposed by Civil Aviation Authority.

Taking into consideration these factors, car parking decks on habitable floors are permitted, he added.

His affidavit denied any violation by BMC in allowing construction of balcony in an excess of sanctioned plan.
