MUMBAI: The Bombay High Court on Wednesday asked Raj Thackeray's lawyers to file an affidavit giving a time- line of developments that took place at the Kalyan magistrate's court on October 22.
The hearing of the petition, filed by the state government, has been deferred till November 25.
The petition challenges Kalyan sessions court's order not to arrest the MNS chief during the pendency of his anticipatory bail application and magistrate's order 'recalling' his own earlier order giving Raj's custody to Railway Police.
Justice V K Tahilramani said she would not interfere with the sessions court's order giving Raj interim relief as the government had an opportunity to raise the same issues before that court.
The High Court will only consider the second issue, she said.
On October 22, Raj was brought to Kalyan magistrate's court by Dombivali police, who had booked him in a case related to MNS workers' attack on north Indian candidates of a Railway Board examination.
The magistrate granted Raj bail. Immediately, Government Railway Police moved the court, seeking Raj's custody, as they wanted to produce him before the Railway court in a similar case.
According to the prosecution, Magistrate gave the GRP Raj's custody, but immediately Raj's lawyers pointed out that they had filed anticipatory bail application before sessions court, which had ordered that Raj not be arrested till October 24.
The magistrate then recalled his earlier order granting GRP Raj's custody.
