Sessions judge ST Mahajan on Thursday summoned Mallika Sherawat to appear before him on October 7, in a review of an obscenity case filed by Vinod Jain against her and the management of the hotel JW Marriott.
In his complaint to the Bandra magistrate, Jain had contended that on December 31, 2006, he had viewed on TV, Sherawat’s dance at the hotel and had found it extremely obscene.
In August 2008, the magistrate discharged both accused before issuing process against them. If convicted, the accused would be liable to spend a maximum of three years in jail and pay a fine of Rs1 lakh.
However, Jain approached the sessions court for a review of that order. “Such dancing is permissible in a movie as a person can choose to watch a movie or otherwise,” Jain said. “There is a censor board to monitor films but no such authority for TV shows. Any child may unwittingly witness this obscenity,” he continued.
After October 7, Mahajan will review the order of discharge and see if there is any substance in the complaint.
