Man in custody escapes twice, FIR against cops

Additional public prosecutor VB Konde-Deshmukh on Monday told the Bombay High Court that an FIR had been registered against constable Avinash Patil and police naik Yashwant Mahale in the case of Amman Siddiqui, 25, who escaped from the Oshiwara police station lock-up in March 2007.

Siddiqui was arrested in connection with the kidnapping of a bar dancer Dolly, who eventually returned safely.

He said that the two policemen were booked under section 201 (causing disappearance of evidence of offence, or giving false information to screen offender) and section 221 (intentional omission to apprehend on the part of public servant bound to apprehend).

Last week, the court had asked the police to file a report in the case after the police was unable to trace Amman for months. Justices RMS Khandeparkar and Amjad Sayed were, however, not impressed by the report submitted to the court on Monday and asked for a detailed report of investigations in the case.

The court warned that if a detailed report regarding the investigations in the case is not furnished, it would hand over the probe to the CBI.

Siddiqui was arrested on March 4 last year but he escaped from the custody only to be rearrested on March 23 from Khar. The police said that he again escaped on March 28 on the pretext of using the toilet and has not been traced since.
