Joint civil judge (senior division), AN Mare, on Friday extended the stay on the eviction of the residents of Padalvasti served by the army authorities till Saturday.

The stay was granted to allow the army counsel, SM Jagtap, to file his say before the court on the points raised by the lawyers representing Padalvasti residents, Vijay Kale and Manoj Nayak.
Residents of Padalvasti slum in Bopodi were served eviction notice by the army authorities in April this year.

The defence authorities had claimed that the land on which the Padalvasti slum stands was theirs, and the slum was an illegal encroachment.The slum dwellers approached the district court, which had initially granted stay till June 30 on the eviction notice.

On Thursday, when the counsel for the residents of Padalvasti had filed for an extension of the stay, the court had granted a day’s extension.While arguing the case on Friday, Nayak had asked why the army authorities were silent when the Pune Municipal Corporation (PMC) had declared Padalvasti as a slum in 1984. 

“Also the army authorities had kept silent when the PMC had put reservations of 24-metre high capacity mass transit route (HCMTR) and a 30-metre road on this land. In view of the earlier silence, we had asked why the eviction notices were served now,” he said.
