The Session's court recently denied bail to an accused arrested in a Protection Of Children Against Sexual Offenses Act (POCSOA) case. While denying theapplication the court ruled that the victim's statement was strong enough to affirm mutliple sexual abuse and such an accused does not deserve bail.
The court held that the offense was committed in the bay near the house of the accused and if he is granted bail, he might try to tamper with the evidence and even continue to assault minors.
The case dates back to February 2018, when the accused, who was acquainted to the 12-year-old victim, had abused the child mutliple times. After being assaulted on four occasions, the child informed his mother, who then approached the RAK Marg police station and filed a complaint.
The defense advocate, while arguing on behalf of the bail application, held that the accused has been wrongly implicated. "There was a feud between the family and the accused and the boy is being used as a tool to harass the accused," held the defense advocate. The advocate also said that there was a delay of four days in registering the FIR and that the prosecution has no evidence apart from the boy's verdict to prove the offense.
The court, after going through the evidence, held that the victim has given a confident statement before three authorities, which makes the case strong and credible. "Thus, delay in registering the offense is no ground to disbelieve the child," held the court.
