In the eyes of law, a police diary is a statement of the police. The defence said it wanted to access the record to cross examine accused-turned-approver Syamwar Rai with his statement recorded at the time of his arrest.

Defence lawyers in the Sheena Bora murder case on Tuesday presented before the Sessions Court an argument for seeking access to the police diary.

In the eyes of law, a police diary is a statement of the police. The defence said it wanted to access the record to cross examine accused-turned-approver Syamwar Rai with his statement recorded at the time of his arrest.

After being denied by the trial court, application for access to the police diary was made at the Bombay High court. HC, however, sent the matter back to the Sessions Court to hear the arguments once again and re-decide on the matter.

The defence in its arguments said access to the police station diary would help clear facts.

Meanwhile, the Central Bureau of Investigation (CBI) has handed over a copy of Rai's initial statement to all three accused. The CBI, however, is yet to hand over soft copies of additional documents, including Sheena Bora's call data records requested by the accused.

Indrani, her ex-husband Sanjeev Khanna and her driver Rai had allegedly planned and killed Indrani's daughter Sheena Bora. Later her husband Peter Mukherjea was arrested for allegedly being part of the conspiracy.
