The Bombay High Court on Friday gave DGP PS Pasricha four weeks to take “appropriate” action and give his sanction to prosecute 14 cops implicated in Khwaja Yunus’s death.
The DGP’s affidavit presented in court on Friday stated that his office had not received any proposal from the CID to transfer police with the Ghatkopar police station. Out of 14 accused cops, eight have been suspended, two transferred and the remaining four are likely to be shunted soon.
The DGP further stated that his office had not received any letter from the CID, seeking his approval to prosecute the 14 accused officers, which government lawyer Satish Borulkar alos brought up. CID advocate RB Mokashi contested this stand.
Justices JN Patel and Roshan Dalvi were angered at the “inaction” on the DGP’s part, and they said he could have asked for the investigation records and followed up.
If the DGP gives his sanction to prosecute the 14 cops, Yunus’s mother Aasiya will be able to legally claim compensation for his custodial death. The HC has also directed the CID to hire legal advisors within the next two weeks.
