Suspended Indian Premier League (IPL) chairman Lalit Modi has asked the disciplinary committee formed by the Board of Control for Cricket in India (BCCI) to provide him with minutes of meetings of the special general body of the board and the IPL governing council held after his suspension, sources said today.
In an application to the disciplinary committee yesterday, Modi has also asked for a copy of the amended agreement between the board and Sony-MSM, they said.
When contacted, Modi's legal counsel Mehmood Abdi told PTI, "We have asked for some documents. These are crucial to the proceedings which are already underway as the disciplinary committee and the jurisdiction of the disciplinary committee flows from these documents."
"It is essential for us to have access to these documents since the contents we've asked will have far-reaching implications for us. BCCI should provide us these documents as the same have implications on the co-issue of recusal, which the disciplinary committee is scheduled to finally decide at its meeting on July 27, 2010 in Delhi," he said.
Modi has given detailed reasoning for seeking these documents.
As regards seeking copy of the amended agreement between the Board and Sony-MSM, he has said that the board in it's affidavit before the Bombay high court admitted that a decision was taken by the governing council to cancel the agreement between WSG-BCCI and to enter into an amended agreement with MSM Sony.
"... such a decision and the execution of a subsequent amended agreement has been relied upon by the Board to substantiate the allegation of the purported loss of $80 million caused to the board by the actions of the applicant.
"The said affidavit also shows that the board has taken a categorical stand as to the guilt of the applicant vis-a-vis issue of SONY-MSM-WSG-BCCI issue relating to facilitation fees of $80 million and the recusal of Mr Chirayu Amin. In the circumstances, the minutes of the meeting dated 24th June 2010 along with list of members present and the amended agreement dated 25th June 2010 executed between BCCI-SONY MSM are relevant and crucial to the present proceedings. They are directly relevant to the contention raised by the applicant ...," he said.
For seeking copies of the minutes of the special general body meeting of July 3 alongwith the list of members present, Modi said, "... the board has pleaded before the Bombay high court that the appointment of the present committee and its charter flows out of the decision taken by the members of the Board in the said meeting."
"... the jurisdiction of the present committee stems from the said minutes hence it is necessary that these be provided to the applicant," Modi said.
