Trouble is mounting for PDP rebels as the party is mulling to issue showcause notice to five of its lawmakers who raised a banner of revolt against the leadership of former chief minister Mehbooba Mufti.
Sources said PDP disciplinary committee is meeting soon to finalise the showcause notices to former sports minister and MLA Pattan, Imran Reza Ansari; MLA of Baramulla Javeed Baigh and MLA of Noorabad constituency Abdul Majeed Padroo. Two MLCs — Yasir Rishi and Saifuddin Bhat will also be served the showcause notice.
All of them had held a news conference on Friday, where they claimed to be 'the real PDP' and expressed no-confidence in the leadership of Mehbooba Mufti.
Sources said the showcause notice is aimed at sending a strong message and quelling the rebellion in a bid to stop the attempts of poaching by other parties. Jammu and Kashmir has a stringent anti-defection law, which makes it almost impossible for MLAs to defect in the restive state.
On December 30, 2005, Jammu and Kashmir Legislative Assembly passed a Bill, deleting the Para three of schedule 7 of the Jammu and Kashmir Constitution, under which if one-third of MLAs of any party formed a separate group, it was bound to get recognition in the House.
Under this law, two-third legislators of the party are needed to be recognised as a separate group in the House. The salient feature of the anti-defection law in Jammu and Kashmir is that the power to disqualify the member lies with the leader of the legislature party and not the speaker.
