Jammu and Kashmir High Court today deferred its order on transfer of case of alleged rape and murder of two women in Shopian to the CBI till August 26 pending the time given to other parties to file their objections to the state's decision.

While deferring the order till next Wednesday, a division bench comprising chief justice Barin Ghosh and justice Mohd Yaqoob Mir observed "we will not stand in the way of transferring the case to CBI as it is for the government to decide which agency it entrusts with the investigations."

Kashmir Bar Association has decided to file objections to the state’s plea for transferring the case to CBI claiming that the past record of the investigating agency was not good during the 2006 sex scandal.

The court sought cooperation from Shakeel Ahmad Ahangar, husband of Neelofar Jan and brother of Aasiya Jan the two victims, and the people of Shopian in unraveling the truth in the case.

It added that their cooperation had become inevitable as the crucial evidence on which the court was banking has now become disputed.

Majlis Mushawarat Shopian, which was spearheading the 47-day agitation over the incident, sought a week’s time to submit its suggestions to the court.

The Jammu and Kashmir Government had filed an application before the bench on Monday seeking permission to transfer the case to the CBI after questions were raised on the probe being carried out by Special Investigation Team (SIT) by some members of the legislative assembly.

The bench also observed that it will intervene if the investigations, if transferred to the CBI, are entrusted to an officer below the rank of superintendent of police.

Asked about the latest developments in the court, minister for law Ali Mohammad Sagar said the orders of the court have not come as of yet. "Once we receive the orders of the Honourable High Court, we will discuss the next course of action in the case."

He said Government was committed to find the truth in the case and seek exemplary punishment from the courts for those who committed the heinous crime.
