The Rajasthan High Court stayed the execution of the order of the Home Minister Gulab Chand Kataria to change the investigating officer (IO) of a minor’s rape case in which the principal of a school has been accused of raping the victim. Along with this, the High Court also rejected the criminal petition filed by the accused to quash the FIR in the matter. The single bench of Justice K S Ahluwalia gave the order in response an application filed by Yogesh Sharma.

In the petition, it was said that the principal has been implicated in the rape case. It also claimed that the girl’s family members had not deposited the fee amount and thus they registered a false case against the accused.

Interestingly, the applicant had produced several affidavits from students and locals from the area in support of his claims after which the application to quash the FIR was moved.

Meanwhile, on behalf of the state government, it was said that even though it was a holiday on January 7, the accused had called the victim girl and few other girls to school. It was further said in the court that the man raped the victim in the canteen of the school located in Mathuragate police station area of Bharatpur city. During the investigation by the Circle Officer, Bharatpur city, and later by the Superintendent of Police, Bharatpur, the rape was proved.

Apart from that, the police will file a chargesheet against the accused soon.

Meanwhile, it came to light in the court that the Home Minister had ordered that the investigation into the matter be handed to Additional Superintendent of Police of Deeg. Upon this, the Court stayed the execution of orders of the Home Minister.
