The detection of crime branch (DCB) had registered a case at its police station in Ahmedabad after the police encounter on June 15, 2004, in which Ishrat Jahan and three others were shot dead.

The Tamang report, whose contents leaked to the public recently,  states that the encounter was fake. The Gujarat high court has stayed the report but the role of police is still suspect. Strangely, the case registered by DCB does not doubt the police encounter.
DCB later tried to close the case by filing a summary report in the Pota court as Ishrat and others were dead. But the case continues and the crime branch keeps filing probe progress reports, though the investigating officers have changed thrice.

The reason for this is that DCB is still ‘looking’ for the five persons who, it says, allegedly hatched the conspiracy with Ishrat and friends to kill chief minister Narendra Modi.
Police sources said of the five, Abu Muzammil was hiding in Pakistan, Md Mehraj was absconding and three others were in the custody of J&K Police, which refuses to hand them over. 

“We had sent an officer to J&K to take custody of the absconding accused,” ACP Usha Rada said. “Now, the case papers have been handed over to the HC-constituted SIT.” The last progress report in the case was filed by DCB in the Pota court four months ago.
