A Thane sessions court, while acquitting a cop accused of supplying cannabis in jail, held that the prosecution failed to correctly describe the seized sample. The court held it was essential to describe ifleaves seized had fruits or tops so as to fit into the definition of ganja as described under the Narcotic Control and Psychotropic Substance (NDPS) Act.

The court held: “The prosecution said that except the word Ganja or by referring the seized sample as greenish leaves having strong smell, nothing else has been referred either in chargesheet or even in panchnama to prove the guilt of the accused.”

Mayur Chindarkar (28) was arrested by the Thane Nagar police in March 2014, when he was allegedly found in possession of 252 grams of ganja, worth Rs 1,600. The prosecution held that Chindarkar had kept the samples in his socks and was trying to supply it inside Thane Central Prison. 

The accused’s advocate, Shekhar Bhandary, told the court that the prosecution had failed to explain the right description of the substance.
