The India-Australia custody battle got tougher as both parents of three-and-a-half-year-old Ayan (name changed) refused to relent. Ayan’s mother Clara Gannon, 25, who flew down from Australia a month back, said on Monday that she will do all it takes to take her son back home with her.

Justice Bilal Nazki and Justice AR Joshi interviewed Gannon and her former Indian husband Faizal Javed (name changed) in their chamber. The judges had earlier asked the couple to have a meeting and come to a conclusion.

After meeting on Saturday, however, they failed to arrive at a settlement and both Gannon and Javed are unwilling to let go of the child.

“I spent two-and-a half hours with Ayan on Saturday. He’s been away from me but he remembers me. He said, “Mummy I want to go with you,” Gannon said. She added, “He was happy and he took the stress off me too.”

However, when interviewed by the judges on March 21, Ayan had said that wanted to stay with his father. Gannon’s advocate Vatsal Shah said, “The child is only three years old and easily impressionable.” The court has adjourned the case for further hearing on March 30.

Gannon said, “I’m ready to pay for Ayan’s father’s visits to Australia but I want to take my son with me.” On Friday, Javed made the same offer to Gannon.

Gannon had alleged that Javed had flouted the Australian court’s order that had given Ayan’s custody to her after the couple got divorced in November 2007. The court had allowed Javed to bring Ayan to India for 11 days only, Gannon stated. Earlier, Javed had stated that Ayan’s mother was not in a position to take good care of him and raised questions about her character.

Gannon said the allegations levelled by Javed are not true. “My kids back in Australia miss me too but I’ve got to fight for Ayan,” she added.
