Jaidev Thackeray, estranged son of late Bal Thackeray, on Monday informed the Bombay High Court during his cross examination that Shiv Sena chief Uddhav Thackeray has not been answering his calls or replying to messages ever since he filed the suit in court, challenging the Will of Thackeray.

Jaidev, who appeared unwell and was wearing a neck support, replied to the questions by sitting on a chair kept inside the witness box. He was brought to the court in a wheel chair and once during the hearing he complained of ill health and sought adjournment. However, he returned after court allowed a small break to him.

When counsel Rohit Kapadia, appearing for Uddhav, asked Jaidev whether he meant that his relations before filing of the suit with Uddhav were cordial, he replied that even before that he was not on
speaking terms with his brother and that they have not met or spoken since 2013, but from his side the relation was cordial. However, he added that disagreement and discord can arise even without exchange of words between two people.

The court is hearing a suit filed by Uddhav and others seeking a probate of the will made by the late Sena supremo, while Jaidev has challenged the same. The court was further told that he shifted out of Matoshree bungalow in 1995 and moved to an apartment in Dadar where he stayed by Bal Thackeray. Later, he purchased a flat in Kalina with his own funds and moved there. After which he moved to Kala Nagar.

As regards to he coming to know of the will being made by Bal Thackeray, the court was told that while surfing the internet Jaidev and his wife came across an article in a newspaper which mentioned about the will. The court also asked him to point out from the affidavit statements mentioned, which he knew on his own and those information that he derived from other sources.

Thackeray had prepared and executed his first will in 1997, and thereafter, around eight to nine wills were executed, until the final one in 2011. A dispute arose over the will dated December 13, 2011, after Jaidev moved HC, alleging that his father had not been in sound mind while executing the will.

Earlier, the court had asked the parties to settle the dispute, but it was not resolved. Thackeray died on November 17, 2012. The cross examination will continue on Tuesday.
